GDPR information notice
Information on the processing of the personal data of persons contacting the firm and of the firm’s clients – in accordance with Art. 13 GDPR.
Data controller
The controllers of your personal data are: advocate (adwokat) Magdalena Eckersdorf, who runs an Advocate’s Law Office, and attorney-at-law (radca prawny) Marta Siewiera-Misiuda, who runs an Attorney-at-Law’s Office (hereinafter jointly: “E&S Law Firm” or the “Firm”), with their registered office at ul. Narutowicza 54 lok. 15, 90-136 Łódź.

Purposes and legal bases of processing
We process your data for the purpose of:
- replying to your e-mail or telephone enquiry and contacting you about your matter – on the basis of our legitimate interest in conducting correspondence (Art. 6(1)(f) GDPR) and, where the contact concerns the conclusion of a contract, in order to take steps prior to entering into it (Art. 6(1)(b) GDPR);
- concluding and performing a contract for the provision of legal assistance, including representation before courts, authorities and insurers (Art. 6(1)(b) GDPR and, with regard to special categories of personal data, Art. 9(2)(f) GDPR);
- complying with the legal obligations incumbent on the Firm, including tax and accounting obligations and those arising from anti-money laundering legislation (Art. 6(1)(c) GDPR);
- establishing, exercising and defending claims (Art. 6(1)(f) GDPR).
Recipients of data
The recipients of the data may include entities providing IT, hosting, postal, courier and accounting services to the Firm and, to the extent necessary to handle a case, courts, administrative authorities, insurers, bailiffs, notaries, court experts, valuers, sworn translators and cooperating law firms in Germany, Austria and Switzerland.
Retention period
We keep correspondence until it ends, but no longer than 12 months from the last contact. We keep client data for the duration of the contract and then for 10 years from the end of the year in which the proceedings in which the data were collected ended – in accordance with the legislation governing advocates and attorneys-at-law. We keep accounting documents for the period required by tax legislation.
Your rights
You have the right to:
- access your data and obtain a copy of them
- rectification (correction) of your data
- erasure of your data – where there is no basis for further processing
- restriction of processing
- data portability – with regard to data processed on the basis of consent or a contract
- object to processing based on legitimate interests
- withdraw your consent at any time – without affecting the lawfulness of processing carried out before its withdrawal
- lodge a complaint with the President of the Personal Data Protection Office (UODO), ul. Stawki 2, 00-193 Warszawa
Voluntary provision of data
Providing your data is voluntary, but it is necessary in order for us to reply to your message or to conclude and perform a contract for the provision of legal assistance. We do not make decisions by automated means and do not profile data subjects.
Professional secrecy
Advocates and attorneys-at-law are obliged to keep secret everything they have learned in connection with providing legal assistance. To the extent provided for by law, professional secrecy takes precedence over information obligations and certain rights under the GDPR.
